ATV

§60-103

An ATV is defined as any motorized off-highway vehicle which is 50 inches or less in width; has a dry weight of 1200 pounds or less; travels on 3 or more non-highway tires; and is designed for operator use only with no passengers, or is specifically designed by the original manufacturer for the operator and one passenger.

A Certificate of Title is required for all ATVs sold new on or after January 1, 2004. ATVs purchased prior to January 1, 2004, may be issued a Certificate of Title at the request of the owner with the presentation of the appropriate documentation to their County Treasurer.

To obtain a Certificate of Title for an ATV, one of following documents must be presented to the County Treasurer:

  • Manufacturer’s Statement of Origin (MSO)
  • Certificate of Title – properly assigned
  • Affidavit for Verification of Ownership of an ATV, Minibike, UTV or Minitruck
  • Last registration and a Bill of Sale for used ATVs if previous location was not a title issuing state
  • ATVs registered by the U.S. Military: U.S. Military Registration Document
  • ATVs sold by the U.S. Government: U.S. Department of State Certificate of Title
  • ATVs registered in a foreign country: a current Registration Certificate and/or a Bill of Sale, foreign country ownership documents and import papers
  • Court Order

AND all of the following documents:

Certificates of Title issued for ATVs are intended as proof of ownership only and will contain the statement, “Not To Be Registered For Road Use.”

ATVs are off-road vehicles. They are not registered and any on-road use is limited to the restrictions set by state statutes. Refer to 60-6,355 through 60-6,362 for specific information related to these restrictions. If you are uncertain where an ATV can be operated in your area, contact your local city Police Department or County Sheriff’s Office.

ATVs which have been modified or retrofitted with after-market parts to include additional equipment other than headlights, taillights, brake systems, muffler systems, or a spark arrester shall not be registered, nor shall such modified or retrofitted vehicles be eligible for registration in any other category of vehicle.

Application for Certificate of Title is made to the County Treasurer in the county where the owner resides and must be obtained within thirty (30) days of the date of purchase of the vehicle.

Sales tax must be paid to the County Treasurer at the time of title issuance.

Minibike

§60-121

 

A Minibike is defined as a two-wheeled motor vehicle that has a total wheel and tire diameter of less than 14” or an engine-rated capacity of less than 45cc, or any other two-wheeled motor vehicle designed by the manufacturer for off-road use.

 

A Certificate of Title is required for all Minibike’s sold new on or after January 1, 2004. Minibikes purchased prior to January 1, 2004, may be issued a Certificate of Title at the request of the owner with the presentation of the appropriate documentation to their County Treasurer.

To obtain a Certificate of Title for a Minibike, one of the following documents must be presented to the County Treasurer:

  • Manufacturer’s Statement of Origin (MSO)
  • Certificate of Title – properly assigned
  • Affidavit for Verification of Ownership of an ATV, Minibike, UTV or Minitruck
  • Last registration and a Bill of Sale for used Minibike’s if previous location was not a title issuing state

UTV

§60-135.01

A Utility Type Vehicle (UTV) is defined as any motorized off-highway vehicle which (a) is seventy-four inches in width or less, and (b) is not more than one hundred eighty inches, including the bumper, in length, (c) has a dry weight of two thousand pounds or less, and, (d) travels on four or more non-highway tires.

A Certificate of Title is required for all UTVs purchased new on or after January 1, 2011. UTV's purchased prior to January 1, 2011, may be issued a Certificate of Title at the request of the owner with the presentation of the appropriate documentation to their the County Treasurer.

To obtain a Certificate of Title for a UTV purchased prior to January 1, 2011, one of the following documents must be presented to the the County Treasurer:

  • Manufacturer’s Statement of Origin (MSO)
  • Certificate of Title – properly assigned
  • Affidavit for Verification of Ownership of an ATV, Minibike, UTV or Minitruck
  • Last registration and a Bill of Sale for used UTV ’s if previous location was not a title issuing state
  • UTV's registered by the U.S. Military: U.S. Military Registration Document
  • UTV's sold by the U.S. Government: U.S. Department of State Certificate of Title
  • UTV's registered in a foreign country: a current Registration Certificate and/or a Bill of Sale, foreign country ownership documents and import papers
  • Court Order
